This is a translation for your convenience. The legally binding version is the German Datenschutzerklärung.

Here you can find out which personal data is processed when you visit this website, write to me, book an appointment or talk to me by video, and which rights you have.

2. The key points

  • This website does not use any analytics or tracking services.
  • Fonts and images are loaded from this website's own server. No data is transferred to Google or other third parties when you open the pages.
  • The Calendly booking calendar and the Google Maps map are only loaded if you consent. Only then is data transferred to these providers and cookies may be set.
  • Google reviews are shown as text. No connection to Google is made for this.
  • Instagram and Pinterest are only linked. Data only flows to them if you click one of these links.

3. Hosting and server log files

The website is hosted by Netlify, Inc., 101 2nd Street, San Francisco, CA 94105, USA. Each time a page is accessed, Netlify processes technically necessary data so that the page can be delivered and run securely, in particular:

  • IP address of the requesting device,
  • date and time of access,
  • page or file accessed,
  • referrer URL (the previously visited page), if transmitted,
  • browser type, operating system and language (user agent).

The legal basis is Art. 6 (1) (f) GDPR. My legitimate interest lies in providing the website in a stable, secure and error-free way. A data processing agreement pursuant to Art. 28 GDPR is in place with Netlify.

Netlify also processes data in the USA. Netlify is certified under the EU-U.S. Data Privacy Framework. The transfer is therefore based on the adequacy decision of the EU Commission (Art. 45 GDPR). How long Netlify stores log data is set out in Netlify's privacy notice: netlify.com/privacy.

4. Cookies, local storage and consent

The website itself does not set any cookies. On your first visit, a banner asks whether you want to allow external content: the Calendly booking calendar and the Google Maps map, each selectable separately. Your choice is saved in your browser's local storage (localStorage) under the name "kl-consent" so that the banner does not appear again on every page. This storage is strictly necessary for the service you requested (§ 25 (2) no. 2 TDDDG) and only contains your choice and the date.

External content is only loaded with your consent (§ 25 (1) TDDDG, Art. 6 (1) (a) GDPR). You can withdraw or change your consent at any time with effect for the future via the "Cookie settings" link in the footer of every page.

5. Contact form

If you write to me via the contact form, I process your first and last name, your email address, the topic you selected, your message and the date and time of the request. I use this data exclusively to answer your request and, if applicable, to prepare a quote.

The form is processed via the Netlify Forms service: your entries are stored at Netlify and sent to me by email. The information under section 3 applies to Netlify (data processing, transfer to the USA). A hidden field is used to block automated spam.

The legal basis is Art. 6 (1) (b) GDPR insofar as your request aims at a contract with me, and otherwise Art. 6 (1) (f) GDPR. My legitimate interest is answering your message. Providing the information is voluntary. Without a name, email address and message, however, I cannot reply to you.

I delete the data as soon as your request has been fully dealt with and no statutory retention obligations (for example for business letters or invoices) apply.

6. Contact by email or phone

If you send me an email or call me, I process the data you share with me in order to deal with your request. Legal basis and deletion as under section 5.

7. Appointment booking via Calendly

You can book an appointment for the free consultation and for Call a Designer via Calendly. The provider is Calendly, LLC, 115 E Main St., Ste A1B, Buford, GA 30518, USA.

Embedded calendar: The booking calendar is embedded directly on the "Free consultation" and "Call a Designer" pages. It is only loaded once you consent in the cookie banner or via "Load calendar". Your browser then connects to Calendly's servers. Calendly receives technical data such as your IP address, browser and device information and the page accessed, and sets cookies. The legal basis is your consent (§ 25 (1) TDDDG, Art. 6 (1) (a) GDPR). Without consent, you can open Calendly via a link in a new tab instead.

Booking: When you book, Calendly processes the data you enter there (in particular name, email address, chosen time, your information about your request and, for Call a Designer, your declaration on the right of withdrawal) and passes it on to me. Calendly acts as my processor pursuant to Art. 28 GDPR. The legal basis is Art. 6 (1) (b) GDPR (pre-contractual measures or performance of the contract).

Calendly is certified under the EU-U.S. Data Privacy Framework; the transfer to the USA is based on the adequacy decision of the EU Commission (Art. 45 GDPR). Details: calendly.com/privacy.

I store appointment data for as long as it is needed to carry out and invoice the appointment, and beyond that only within the scope of statutory retention obligations.

8. Video calls via Google Meet

I hold Call a Designer and, if we agree on it, other conversations via Google Meet. I use Google Meet and Google Calendar as part of Google Workspace. The provider is Google Cloud EMEA Limited, 70 Sir John Rogerson's Quay, Dublin 2, Ireland. Google processes the data as my processor on the basis of a contract pursuant to Art. 28 GDPR. Calendly creates the meeting link via my Google Calendar when you book.

When you take part, Google processes in particular your name or display name, your email address, video and audio data during the call, your IP address, device and connection data, and appointment and meeting metadata. Calls are not recorded. You can control your camera and microphone yourself at any time.

The legal basis is Art. 6 (1) (b) GDPR (performance of the contract or pre-contractual measures). Google may also process data in the USA. Google LLC is certified under the EU-U.S. Data Privacy Framework; the transfer is therefore based on the adequacy decision of the EU Commission (Art. 45 GDPR). 9. Google Maps

On the home page I can show you my location on a Google Maps map. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The map is only loaded once you consent in the cookie banner or via "Load map". Your browser then connects to Google's servers. Google receives in particular your IP address, browser and device information and the page accessed, and may set cookies. If you are logged in to Google, Google can link the visit to your account.

The legal basis is your consent (§ 25 (1) TDDDG, Art. 6 (1) (a) GDPR), which you can withdraw at any time via "Cookie settings" in the footer. Google may also process data in the USA; Google LLC is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR). Details: policies.google.com/privacy.

The links "Plan route" and "View on Google Maps" are simple links. Data only flows to Google if you click them.

10. Google reviews

On the home page I show selected reviews from my Google Business Profile with the authors' first names and abbreviated last names. The texts are built into the page; no connection to Google is made when you open it. The legal basis for showing them is my legitimate interest in showing prospective clients the experiences of other clients (Art. 6 (1) (f) GDPR). If you do not want your review to appear here, you can write to me at any time and I will remove it.

Note on authenticity (§ 5b (3) UWG): The reviews are not checked by Google or by Kaysser Living as to whether the authors actually used the service.

11. Client projects

When we work together, I process the data needed for planning, communication and invoicing, for example contact details, floor plans, photos and measurements of your rooms. The legal basis is Art. 6 (1) (b) GDPR. I keep tax and commercial records for as long as the law requires (Art. 6 (1) (c) GDPR). Further details can be found in my terms and conditions (German).

12. Links to Instagram and Pinterest

This website links to my profiles on Instagram (Meta Platforms Ireland Limited, Merrion Road, Dublin 4, Ireland) and Pinterest (Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland). These are simple links, not embedded plugins. No data is therefore transferred to these platforms when you visit my website.

If you click a link, you are taken to the respective platform, where its privacy policy applies. When you visit my Instagram profile, I am jointly responsible with Meta for the statistics Meta provides to me about the profile (Insights) (Art. 26 GDPR). Meta has committed in an agreement to take on the main obligations for this. You can exercise your rights directly with Meta or with me.

13. Encryption

For security reasons, this website uses TLS encryption. You can recognise it by the padlock symbol and "https://" in your browser's address bar.

14. Your rights

Under the GDPR you have the following rights towards me:

  • access to the data stored about you (Art. 15 GDPR),
  • rectification of inaccurate data (Art. 16 GDPR),
  • erasure (Art. 17 GDPR),
  • restriction of processing (Art. 18 GDPR),
  • data portability (Art. 20 GDPR),
  • withdrawal of consent with effect for the future (Art. 7 (3) GDPR).

Right to object (Art. 21 GDPR): Insofar as I process data on the basis of Art. 6 (1) (f) GDPR, you can object to this processing at any time on grounds relating to your particular situation. I will then no longer process the data unless there are compelling legitimate grounds that override your interests, or the processing serves the establishment, exercise or defence of legal claims.

An informal message to info@kaysserliving.com is enough for all requests.

Right to lodge a complaint: You can lodge a complaint with a data protection supervisory authority. The authority responsible for me is: Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg, Heilbronner Straße 35, 70191 Stuttgart, Germany, www.baden-wuerttemberg.datenschutz.de.

15. No automated decision-making

No automated decision-making, including profiling (Art. 22 GDPR), takes place.
